Order Conditions

Article 1 - Order Terms
  • To place an order, the customer must indicate his or her name, first name and address.
  • Le client affirme au préalable avoir déjà réservé un séjour à l’Atrium de la Sole.
  • The customer's order is guaranteed as soon as the host has received partial or full payment in accordance with the payment terms.
  • The Host reserves the right to cancel the order if payment is not received. A confirmation of cancellation will be sent by e-mail immediately after the order has been cancelled.
Article 2 - Content of the ordered services
  • The order of additional services to the stay includes the elements indicated on the description of the service. 
  • Please note that the photos of the service are not contractual.

Terms of payment

Article 3 - Prices
  • The prices for the booking of services are indicated before and at the time of booking. Prices are confirmed to the client in the commercial currency of the establishment and are valid only for the period indicated on the booking platform.
  • À tout moment et sans préavis, L’Atrium de la Sole se réserve le droit de modifier ses prix. Ces modifications n’auront cependant pas d’incidence sur les commandes que l’Atrium de la Sole aurait acceptées avant l’entrée en vigueur de ces modifications.
Article 4 - Payment
  • The payment of additional services related to the booking of a stay is made by credit card through the payment platform chosen by the establishment. Payment may be made by other means.
  • In accordance with Article L133-8 of the french Monetary and Financial Code, and unless otherwise provided by law, the payment service user may not revoke a payment order once it has been received by the buyer's payment service provider.
  • The customer communicates his/her bank details as a guarantee for the reservation (except for special conditions or rates) by credit or debit card (Visa, Mastercard, American Express, Diners Club... according to the possibilities offered by the establishment's reservation platform) by indicating directly, in the zone provided for this purpose (secured entry by SSL encryption), the card number, as well as its date of validity (it is specified that the bank card used must be valid at the time of the consumption of the service) and the visual cryptogramme
  • The payment is debited upon confirmation of the payment of the additional services when booking a stay.
  • In the event of a payment problem, the client must contact his bank on one hand, and the establishment on the other, to confirm his reservation and his method of payment.

Cancellation policy

Article 5 - Cancellation policy
  • Le client peut annuler sans frais toute commande de prestations supplémentaires jusqu’à 5 jours avant le début de son séjour dans le cas où aucun frais de la part de l’hôte n’a déjà été engagé. Au-delà de ce délai, ou si l’hôte a déjà engagé des frais pour cette commande, un remboursement au pro-rata des frais engagés sera effectué.
  • The Host may not be held responsible for the non-execution or poor execution of the reservation in the event of force majeure, the actions of a third party or the actions of the Customer. In the event of force majeure or unforeseeable circumstances (such as compulsory work or work related to exceptional circumstances), the Host reserves the right to cancel the reservation made by the Customer and undertakes to refund the full amount, at no extra cost, within 7 days of the notice of cancellation issued to the Customer.
  • Conformément aux dispositions de l’article L.121-21-8 du Code de la Consommation, le droit de rétractation ne s’applique pas à :  

    • La fourniture de services pleinement exécutés avant la fin du délai de rétractation et dont l’exécution a commencé après accord préalable exprès du consommateur et renoncement exprès à son droit de rétractation.
    • The supply of goods or services the price of which depends on fluctuations in the financial market beyond the trader's control and which may occur during the withdrawal period.
    • The supply of goods made to the consumer's specifications or clearly personalised.
    • The supply of goods that are likely to deteriorate or expire rapidly.
    • La fourniture de biens qui ont été descellés par le consommateur après la livraison et qui ne peuvent être renvoyés pour des raisons d’hygiène ou de protection de la santé.
    • The supply of alcoholic beverages the delivery of which is delayed beyond thirty days and the value of which agreed at the conclusion of the contract depends on fluctuations in the market beyond the trader's control.
Article 6 - In case of cancellation of the stay :
  • The Client may request a refund for the additional services ordered, independently of the refund for the stay.
  • Le remboursement des prestations supplémentaires est conditionné jusqu’à 5 jours avant le début du séjour dans le cas où aucun frais de la part de l’hôte n’a déjà été engagé. Au-delà de ce délai, ou si l’hôte a déjà engagé des frais pour cette commande, un remboursement au pro-rata des frais engagés sera effectué.
Article 7 - In case of postponement of stay :
  • In the event of a legitimate and serious impediment, the Customer may ask the Host to postpone the additional services in the same way as the reservation for the stay.
  • Les produits perissables ayant déjà été acheté par l’hôte et ne pouvant pas être reportés à la date du nouveau séjour seront automatiquement facturé au client sans possibilité de remboursement.
Article 8 - In case of no-show :
  • The total amount of the order will be invoiced according to the general and special conditions of sale.
Article 9 - Conciliation policy for disputes
  • The applicable law is French law.
  • In the event of a dispute, difficulty or contestation relating to the performance, interpretation or breach of this rental contract, the parties shall do everything necessary to find an amicable solution to their dispute. To this end, they undertake to meet at the initiative of the most diligent of them in order to examine the conditions and procedures for implementing a possible amicable settlement.
  • If, however, at the end of a period of two (2) months from the request of the most diligent party, no settlement has been found, each of them shall have the right to refer the matter to the materially and territorially competent courts.

Article 10 - Liability Policy
  • The photos are not contractual.

Article 11 - Customer Security Policy
  • As part of our commitment to guest safety, hosts will not disclose the identity, contact details or presence of a guest to anyone other than the relevant law enforcement agencies if specifically requested by law enforcement.
  • The host accepts no responsibility for any personal injury sustained during the use of the accommodation and residence facilities or the residence swimming pool. 

Terms and Conditions of Use

Article 12 - Intellectual property
  • All texts, images and sounds reproduced on the website of the Host are reserved as intellectual property and for the whole world.
  • These General Conditions do not imply any transfer of intellectual property rights of any kind to the Customer in respect of elements belonging to the Host or its beneficiaries, such as photographs, images, literary texts, artistic works, brands, graphic charters and logos.
  • Under no circumstances may videos or photos of the accommodation created by the Customer be distributed publicly without the consent of the Host.
Article 13 - General Data Protection Regulation (GDPR)
  • The information provided by the guest on the website of the host or by phone/email, are personal data that are processed and used by the host in order to ensure the proper processing of the reservation and the provision of the requested service. This data will be processed in accordance with the RGPD regulations.
  • The client's data will not be used for any other purpose than the rental for which he/she has made a reservation.
  • The Client may exercise his rights of access, opposition on legitimate grounds or without grounds in the case of canvassing and rectification and with regard to information concerning him and being processed by the host, under the conditions provided for by the french law of 6 January 1978.
